🗣️ Simple Explanation
What does this law say? Section 49 of the BNS says that if you help someone commit a crime, and that crime actually happens because of your help, you will be punished the same way as the person who committed the crime. This applies if there isn't a specific punishment already written for your role in the crime. This section replaces the old law.
⚖️ Punishment

Imprisonment up to the same term as the original offence, or fine, or both.

💡 Real Life Example

Rahul convinces Amit to commit a robbery, and Amit robs a bank. Rahul faces the same punishment as Amit. Legal consequence: Rahul can be imprisoned for the same term as Amit.

Priya helps Sneha give false evidence in court, and Sneha gives the false evidence. Priya faces the same punishment as Sneha. Legal consequence: Priya can be punished for the same offense as Sneha.

FREQUENTLY ASKED QUESTIONS
Section 49 of the BNS means that if you help someone commit a crime, and the crime happens because of your help, you will be punished the same way as the person who committed the crime. This applies when there isn't a specific punishment already written for your role in the crime. This ensures that those who help in a crime are also held responsible.
The punishment under Section 49 is the same as the punishment for the original crime that was committed. This can range from fines to imprisonment, depending on the severity of the crime. The police can arrest you without a warrant.
Whether abetment under Section 49 is bailable or not depends on the original crime. If the original crime is bailable, then the abetment is also bailable. If the original crime is non-bailable, then the abetment is also non-bailable. Consult a lawyer for specifics.
